Microsoft Guilty On Three Counts

[Microsoft was found guilty of illegal monopoly maintenance by Judge Thomas Penfield Jackson. Hearings will continue to determine remedies.]

By David McGuire and Robert MacMillan -- "The verdict is in - Microsoft Corp. is guilty on three counts - maintaining its monopoly power through anti-competitive means, attempting to monopolize the Web browser market and tying its Web browser to the Windows operating system. Microsoft said it will appeal the case.

"Assistant Attorney General Joel Klein today said that "No company no matter how powerful... can refuse to play by the rules."

"According to conclusions of law issued today by Judge Thomas Penfield Jackson, Microsoft is guilty of illegal monopoly maintenance, but is not guilty of making illegal exclusive deals with partner companies in order to freeze out its rivals.

"Microsoft's anti-competitive actions trammeled the competitive process through which the computer software industry generally stimulates innovation and conduces to the optimum benefit of consumers," Jackson said.

"According to financial news wires, anticipation of the final decision cost Microsoft about $80 billion, sending the company's value from about $552.9 billion to $472.5 billion. Microsoft shares closed down $15.37 1/2 to $90.87 1/2. Today's decision cost Chairman Bill Gates an estimated $12.1 billion.
